(простое условие; гарантия) 1. Ясно выраженное утверждение в контракте (выраженное условие (express warranty)) либо условие, не сформулированное четко, но понятное сторонам контракта (подразумеваемое условие (implied warranty)). Невыполнение простого условия не делает контракт недействительным (как это бывает при невыполнении условия (condition) контракта), однако дает право требовать выплаты компенсации. См. также: floating warranty( простое условие). 2. Условие страхового полиса, которое подтверждает, что что-то будет сделано или не сделано или что определенная ситуация существует или не существует. Если это условие нарушено, страховщик имеет право отказаться от выплаты страховой суммы, если наступил страховой случай, не связанный с нарушением этого условия. Например, если в полисе страхования домашнего имущества есть условие, требующее использования замков определенного типа на дверях и окнах дома, и выяснится, что такие замки не были установлены, страховщики могут отклонить требование выплаты страховой суммы в связи с гибелью имущества от разрыва водопроводной трубы.
